CIVIL REVISION PETITION No.2292 of 2001
ORDER:
This Civil Revision Petition is filed against the judgment and decree dated 17.07.2000 in O.S.No.98 of 1995 passed by the Court of the Senior Civil Judge, Karimnagar.
The suit was filed to make the award dated 27.09.1995 as rule of the Court.
Heard learned counsel for the petitioners and the learned Government Pleader for Arbitration.
The disputes between the petitioners on the one hand and the respondents on the other hand were referred to arbitration. The arbitrator passed the award dated 27.09.1995. While the petitioners filed O.S.No.98 of 1995 with a prayer to make the award as a rule of the Court, the respondents filed O.P.No.21 of 1996, under Section 33 of the Arbitration Act, 1940, with a prayer to set aside the award. Through a common judgment dated 17.07.2000, the trial Court dismissed the suit and allowed the O.P. The petitioners filed the present Civil Revision Petition against the decree in O.S.No.98 of 1995 and CMA.No.3533 of 2000 against the order in O.P.No.21 of 1996.
The record discloses that a Division Bench of this Court disposed of CMA.No.3533 of 2000 through its order, dated 11.11.2007, indicating certain course of action. In that view of the matter, nothing remains to be decided in this Civil Revision Petition.
Accordingly, the Civil Revision Petition is closed, however by observing that it shall be open to the parties to pursue their remedies
depending upon the outcome of the order passed in CMA.No.3533 of 2000, in accordance with law.
The miscellaneous petitions, if any, filed in this revision shall stand closed. There shall be no order as to costs.
