Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memo of grounds filed therein, the High Court may be pleased to enlarge the petitioner/accused No.2 on anticipatory bail, in the event of his arrest in connection with crime No.23 of 2011 of Vijayapuram Police Station, Chittoor Dist.,
The petition coming on for hearing upon perusing the Memo of grounds filed herein, and upon hearing the arguments of Sri MASTHAN NAIDU CHERUKURI , Advocate for the Petitioner, and of Public Prosecutor for Respondent, the court made the following
ORDER:
This Criminal Petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-A.2 seeking anticipatory bail in connection with crime No.23 of 2011 of Vijayapuram Police Station, Chittoor District, registered for an offence punishable under Sections 467, 468, 471 and 420 of Indian Penal Code.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
Allegation against the petitioner is of obtaining loan by way of pledging
bogus pattadar passbook.
Considering the facts that the occurrence took place in the year 2011 and the petitioner is an agriculturist, this Court is of the view that anticipatory bail can be granted to him.
Accordingly, the Criminal Petition is allowed and the petitioner, in the event of his surrender before the Station House Officer, Vijayapuram Police Station, Chittoor District, within fifteen days from today, shall be enlarged on bail on his executing a personal bond for Rs.5,000/- (Rupees five thousand only) with one surety for the likesum to the satisfaction of the said SHO; and
2) he shall report before the said SHO daily for a period of ten days therefrom.
