A1 and A2 are wife and husband and A4 is their daughter and A3 is their relative. All of them are residents of Kurugonda Village. A1 and P.W.1 are own sisters. There are some misunderstandings with regard to collection of “Podupu Lakshmi’ subscriptions. The accused bore grudge against P.W.1 and her daughter-in-law-P.W.3. On 1.7.2001 at about 3 p.m., while P.Ws.1 and 3 were in the house, all the accused trespassed into the house of P.W.1 and beat P.W.3, as a result of which, she fell down. A1, A3 and A4 caught hold of the tuft of P.W.1 and beat her and then, A2 tried to stab her. P.ws.1 and 3 were taken to the police station and a complaint was given, on the basis of which a case was registered and investigated into. After completion of the investigation, a charge sheet was filed before the Judicial Magistrate of First Class, Kota. The learned Magistrate took the same on file as C.C.No.40 of 2002 and after following due procedure, the learned Magistrate framed charges under Sections 323, 324 and 452 IPC against A1 to A4, read over and explained to them in Telugu, for which they pleaded not guilty and claimed to be tried.
