Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the respondent to enlarge the petitioner/A6 on bail in the event of her arrest in connection with Crime No.102 of 2013, on the file of the Station House Officer, Mudigonda P.S., Khammam District.

The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri V.R. Avula, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.

“This Criminal Petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-A.6 seeking anticipatory bail in connection with crime No.102 of 2013 of Mudigonda Police Station, Khammam District, registered for an offence punishable under Sections 447 and 379 of Indian Penal Code and Section 3 of Prevention of Damages to Public Properties Act.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Petitioner is the owner of the tractor alleged to have been involved in the crime of transporting sand illegally. As such, crime is registered including the name of the petitioner as an

accused.

Considering the fact that the petitioner is a lady and also the nature of allegations, this Court is of the view that anticipatory bail can be granted to her.

Accordingly, the Criminal Petition is allowed and the petitioner, in the event of her surrender before the Station House Officer, Mudigonda Police Station, Khammam District, within fifteen days from today, shall be enlarged on bail on her executing a personal bond for Rs.5,000/- (Rupees five thousand only) with one surety for the likesum to the satisfaction of the said SHO; and

2 ) she shall appear before the said SHO as and when required for the purpose of investigation.”
