spurious pesticide and sell the same to ryots by making machine seal without giving any scope to doubt the genuinity. It is specifically alleged in the charge sheet that LW1 purchased 2 KGs of Lorvin for Rs.1,480/- per KG from A3, LW.3 purchased 18 KGs of Lorvin @ Rs.1,480/- per KG from A1 to A3 and got sprayed on their crops. Apart from LWs.1 to 3, other villagers also purchased the same and used it on their crops. At the same time, two brothers of LW.1, whose lands are located nearby the lands of the respondents 2 to 5 herein, purchased the very same Lorvin pesticide at Guntur and used it on their crops. Suspecting the bonafide and genuineness of pesticide purchased from A2, LW.1 went to the shops of A1 to A3 along with LWs.2 to 4 and questioned about the variations of seals on the packets purchased by them with that of their brothers. A1 to A3 brought them back and while talking with the ryots, threw away the spurious pesticides kept in a cartoon boxes, white and yellow plastic gunny bags in the premises of LWs.7 and 8, whose houses are located just behind their houses. Sensing some fraud, LWs.1 to 4 collected the material, brought them to the police station by a tractor and thereafter lodged a report. Basing on these allegations, a report was given and police registered a case in Cr.No.19 of 2006 under Section 420 of IPC and Section 29(1) of the Act of Ponnur Rural police station against A1 to A3. Subsequently, the police after examining the ryots and after assessing the loss caused to the ryots by using such spurious pesticide, filed a charge sheet against A1 to A4. A1 to A3 are the persons, who are running the said shops and A4, who is the son of A1, has also been looking after the business of A1 since the license stands in the name of A1.
