What the court decided
THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4040 OF 2013
ORDER
Petitioner-A2 approached this Court seeking to quash the proceedings in crime No.22 of 2013 of Varni Police Station, Nizamabad, registered for the offences punishable under Sections 420, 464. 466 IPC & Section 156 (3) Cr.P.C.
Heard arguments and perused the record.
Learned counsel for the petitioner contends that no specific allegations were made against the petitioner to attract the ingredients of the offences alleged in the complaint. He further contends that the dispute is purely civil in nature and only to harass the petitioner, the first respondent filed the complaint.
At this stage, this Court cannot look into the contentions raised by the learned counsel for the petitioner, which is dispute in nature. Further, since the offences alleged against the petitioner are arising out of civil disputes, the respondent-Police are directed to investigate the matter without arresting the petitioner herein and file final report, if any. However, the petitioner is directed to appear before the Station House Officer concerned as and when required.
Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending in this Criminal Petition, if
any, shall stand closed.
