Petition under Sections 437 and 439 of Cr. P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant Regular Bail to the petitioner in connection with Cr.No. 127 of 2013 on the file of Devarapalli Police Station, West Godavari District in the interest of justice.

The Petition coming on for hearing upon perusing the petition and grounds filed herein and upon hearing the arguments of Sri Mangena Sreerama Rao, Advocate for the Petitioner and of the Addl .Public Prosecutor for the Respondent, the Court made the following

ORDER:

“ The petitioner is accused in Cr.No.127 of 2013 of Devarapalli Police Station, West Godavari District, registered for the offences punishable under Sections 354-B, 354-c, 376(2)(J) (K)(N) (The Criminal Law Amendment Act, 2013) of IPC and Sections 3,4 & 5 of Indecent Representation Woman Prohibition Act, 1986 & Section 66 (A) r/w 67 of Information Technology Act, 2000 & 2008 of Devarapalli Police Station.

Heard learned counsel appearing for the petitioner and learned Public Prosecutor representing the respondent-State.

The learned counsel appearing for the petitioner submits that even though 90 days have been elapsed, charge sheet is not filed.

In that view of the matter, I am inclined to grant bail to the petitioner.

¶18

Accordingly, the criminal petition is allowed. The petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the II Additional Judicial Magistrate of First Class, Kovvur.”
