Complainant. Petition under sections 437 & 439 of Cr.PC., praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Crime No. 269 of 2013, dated 18.09.2013, of SHO, Sarpavaram Police Station to release the petitioners on bail in connection with Crime No. 269 of 2013 on the file of SHO, Sarpavaram Police Station .
The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed herein, and upon hearing the arguments of Sri B.S. Kartik, Advocate for the Petitioners and of the Public Prosecutor for Respondent, the Court made the following ORDER:-
“This criminal petition, under Sections 437 & 439 of Cr.P.C., is filed by the petitioner-A5 seeking bail in connection with Cr.No.269 of 2013 of Sarpavaram Police Station, East Godavari District.
Heard learned counsel appearing for the petitioner and learned Additional Public Prosecutor representing the respondent-State.
The case of the prosecution os that A1 to A4 killed the deceased, while he was sleeping in the liquor shop of A5.
Learned counsel for the petitioner submits that no over tact is attributed against the petitioner.
Learned Additional Public Prosecutor submits that investigation in this case is completed.
Considering all aspects of the matter, I am of the view that the petitioner can be granted bail in this case.
Accordingly, this Criminal Petition is allowed. The petitioner-A5 shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Special Mobile Judicial Magistrate of First Class, Kakinada.”
