Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and grounds filed herein the High Court may be pleased to direct the respondent to enlarge the petitioners on bail in the event of their arrest in Crime No.246 of 2013, dated 19-03-2013 on the file of Kukatpally PS., Cyberabad District.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri Sai Gangadhar Chamarty Advocate for the Petitioners and of Additional Public Prosecutor for the respondent, the Court made the following.

Heard the learned counsel appearing for the petitioners/A1 and A-2 and the learned Additional Public Prosecutor representing the State.

This criminal petition is filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail to the petitioners.

It appears that there is a civil dispute between the parties in relation to cancellation of the sale deed which resulted in filing of O.S.No.432 of 2012 on the file of the First Additional District Judge, at Ranga Reddy District by the de facto complainant wherein she alleged that the sale deed which was sought to be cancelled was forged. Basing on the very same allegations, the

petitioners filed the present complaint. Since the dispute is predominantly a civil dispute, I am of the view that the petitioners are entitled for anticipatory bail.

Consequently, the criminal petition is allowed. The petitioners/A-1 and A-2 are directed to surrender before the Station House Officer, Kukatpally Police Station, Cyberabad District within (20) days from the date of this order and thereafter, they shall be released on bail on their executing personal bonds in a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the said S.H.O.
