Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to direct the respondent to release the Petitioner on bail in the event of his arrest in Crime No. 162 of 2013 on the file of the Town Police Station, Tadipatri, Anantapur District.

The petition coming on for hearing, upon perusing the Petition and the Memo of Grounds filed herein, and upon hearing the arguments of SRI P. NAGENDRA REDDY, Advocate for the Petitioner and of the Additional Public Prosecutor on behalf of respondent-State, the Court made the following ORDER :-

“This Criminal Petition is filed under Secs.438 of Cr.P.C. seeking anticipatory bail for the petitioner/A2 in Cr.No.162/2013 o f P.S.Tadipathri Town, Anantapur District, registered for the offences punishable under sections 420, 109, 120-B r/w.34 IPC and Sec.4 of the Price and Chits and Money Circulation Schemes (Banning) Act.

Heard both sides.

The main allegations have been made against A1, A3, A4 & A5. The petitioner/A2 is alleged to have supported them in their business. It is also alleged that the petitioner/A2 has obtained signatures of A6 on some stamp papers and kept them with him. Except that, there is no other allegation made against the petitioner/A2.

The learned counsel for the petitioner/A2 submits that the petitioner/A2 has been running a Telugu daily newspaper and as he has published a news item about the corruption in Tadipathri town, he has been falsely implicated in this case.

Having regard to the facts and circumstances of the case,

the Criminal Petition is allowed, subject to the following conditions;

The Petitioner/A2 is directed to surrender before the Investigating Officer within 2 (two) weeks from today and on such surrender, the Investigating Officer may record his confessional statement, if any given voluntarily, and seize any documents from his possession or at the instance of the petitioner/A2 and then shall enlarge him on bail on his executing a personal bond of Rs.10,000/- (Rupees ten thousand only) with two sureties each in a likesum to his satisfaction. After release, the petitioner/A2 shall cooperate with the Investigating Officer in completing the investigation.
