CIVIL MISCELLANEOUS APPEAL No.1159 of 2009 ORDER : (Per LNR,,J)
This Civil Miscellaneous Appeal, under Section 28 of the Hindu Marriage Act, 1955, is filed against the order and decree, dated 26.10.2009, passed by the Court of the Senior Civil Judge, Nizamabad, in O.P.No.1 of 2007. The respondent filed the O.P. for divorce against the appellant, and the trial Court decreed the same.
The learned counsel for the appellant filed a letter, dated 23.10.2013, stating that the appellant instructed him to withdraw the appeal and, accordingly, sought for permission.
Permission is accorded, and the Civil Miscellaneous Appeal is dismissed as withdrawn. There shall be no order as to costs.
The Miscellaneous Petitions, if any, pending in the appeal shall stand dismissed.
