This Contempt Case is filed alleging willful disobedience of order dated 29-12-2011 in W.P.M.P.No.3333/2011 in W.P.No.2690/2011.

This Court, by the above mentioned order restrained respondent No.2 therein i.e., A.P. Central Power Distribution Company Limited (for short “the Company”) from erecting substation in Ac.5-00 of land comprised in Sy.No.1029 of Malkaram village, Shameerpet Mandal, Ranga Reddy District. Alleging that despite the said order the Company has proceeded with construction of the sub-station, the petitioner filed this Contempt Case against its Managing Director.

A counter-affidavit has been filed by K. Sai Baba, Chief General Manager (Commercial) of the Company wherein it is inter alia stated that the Company has not constructed the sub-station and that on the contrary it is the A.P. Transco which has constructed the sub-station long back.

The petitioners have not filed any reply affidavit controverting the above stand taken on behalf of the respondent.

In my opinion, in the absence of any proof in support of the plea that the Company has constructed the sub-station in question, and that too after the passing of the interim order, no contempt will lie against the respondent. Therefore, the Contempt Case is dismissed, with liberty to the petitioners to pursue the pending Writ Petition.
