This Writ Petition is filed seeking a mandamus declaring the action of the second respondent – Station House Officer, Achampet Post and Mandal, Guntur District, in not taking action on complaints, dated 15.02.2012 and 01.03.2012, lodged by the petitioners, as illegal and arbitrary.

One late Devasahayam, Resident of Guntur, started Jerusalem Prayer House near the road leading to Peddapalem on 27.01.1990. It is a small hut consisting of 50 members initially and strength of it has grown to 400, including women. It is stated that the said prayer house is affiliated to the Society of Trustees of Indigenous Churches in India and there is an elected Managing Committee to it. It is further stated that in recent times, there are some members opposing the activities of the aforesaid prayer house and obstructing the other members from attending the prayers, by using abusive language, and they have also abused the Brother Victor, who is the Pastor of the Church. In this Writ Petition, it is

the grievance of the petitioners that though they have lodged complaints before the second respondent on 15.02.2012 and 01.03.2012, no action has been taken thereon.

A perusal of the complaints stated to have been filed by the petitioners before the second respondent indicates that there is no specific allegation on anybody and the allegations mentioned therein are vague. It appears, as there is a dispute among the members of the society, the petitioners have lodged aforesaid complaints before the police.

In that view of the matter, in the absence of any specific allegations and cognizable contents in the aforesaid complaints, this Court is of the view that the petitioners are not entitled to the relief as prayed for. In any event, the complaints of the petitioners were not registered. There are also other alternative remedies including filing of a private complaint against such persons, who are stated to have been interfering with the prayers in the aforesaid prayer house.

For the aforesaid reasons, the Writ Petition is devoid of merit and it is accordingly dismissed. No order as to costs.
