This Writ Petition is filed seeking a mandamus declaring the action of the fourth respondent – SubInspector of Police, Ambajipeta Police Station, East Godavari District, in harassing the petitioner and his parents at the instance of the fifth respondent, as illegal and arbitrary.

It is the case of the petitioner that he is a permanent resident of Pulletikurru Village, Ambajipeta Mandal, East Godavari District. It is stated that earlier, he was in Hyderabad for a period of ten years and during his stay, he was introduced to Sri K.Anthony and

Sri K.Srinivasa Reddy, who are doing business in real estate, and he worked with them for some time. Thereafter, the said two persons left to Kerala and he left to his native place. In this Writ Petition, it is the grievance of the petitioner that on the ground that he had some transactions with the said K.Anthony and K.Srinivasa Reddy, at the instance of the fifth respondent, the fourth respondent is calling him to the police station and is

harassing and threatening him. Precisely, it is the grievance of the petitioner that in the absence of any crime being registered and complaint being filed against him, there is no reason or justification for the fourth respondent to interfere with his personal liberty and to threaten him and his family members.

When the matter came up earlier for admission on 02.03.2012, it was adjourned to enable the learned Government Pleader for Home to obtain instructions. When the matter is taken up today, based on the written instructions, dated 06.03.2012 sent by the fourth respondent, it is submitted by the learned Assistant Government Pleader for Home appearing for respondents 1 to 4 that the dispute between the petitioner and the fifth respondent is purely of civil nature and the fourth respondent never interfered with the life and liberty of the petitioner. It is further submitted that the allegation of threatening the petitioner by the fourth respondent is absolutely false and the petitioner filed this Writ Petition with false allegations. It is also submitted that neither any complaint is received nor any crime is registered against the petitioner on the file of Ambajipeta Police Station.

As much as it is stated by the learned Assistant

Government Pleader for Home appearing for respondents 1 to 4 that no crime is registered against the petitioner and the petitioner is not required in connection with any case, and the fourth respondent is not interfering with the dispute between the petitioner and the fifth respondent, the Writ Petition is disposed of, placing on record such statements made on behalf of the fourth respondent. However, it is made clear that any such further complaint will be viewed seriously. No order as to costs.
