It is submitted that the land in question has been vested with the Social Welfare Department. It was noticed that a letter has been addressed by the Deputy Director, Social Welfare Department, Hyderabad wherein it has been stated that some unknown persons were constructing six rooms in which four rooms walls were raised upto 4 feet. It is further stated that these facts were also brought to the notice of the Station House Officer, Bahadurpura to take further necessary action for protection of the Government land from illegal encroachments and also to make arrangements for further protection of the land from land grabbers. It is further stated that an inspection was also made by the Mandal Revenue Officer, Bahadurpura Mandal along with field staff and Assistant Social Welfare Officer, Charminar who noticed that four mud walled single rooms with asbestos shed with iron door with lock are constructed over night. It is further submitted that in fact it was a vacant land until the illegal structures were raised. In these circumstances, police protection was also asked by the Assistant Social Welfare Officer, Charminar. A letter was addressed to the Collector, Hyderabad vide Lr.No.B/1268/01, dated 26.2.2004 proposing for demolition of the structure on the above land. It is further stated that on the same day the present writ petition was moved by the writ petitioners and an order of status-quo was granted by the Court. It is further stated that on 28.12.1989 the excess land was handed over to the Mandal Revenue Officer, Bahadurpura to an extent of 4000.64 square meters and 4205.96 square meters covered by encroachments vide file No.CC D1/1933/1976 in Sy.No.1(Part) corresponding to T.S.No.16/1, Block A Ward No.244 of Nandi Musalaiguda village.
