Gudivada Hari Vijaya Kumar Vs The Tahsildar

The petitioners claim to be in possession and enjoyment of different extents of lands situated in survey Nos.274/3, 276/1, 275/1, 275/2, 274/2, 274/1 and 275/3 of Vaivaka village, Mudinepalli Mandal, Krishna District. It is stated that all the lands are assigned lands and D-Form pattas granted to the petitioners are subsisting.

This writ petition is filed alleging that the respondents herein are attempting to dispossess the petitioners forcibly without there being any justifiable reason.

Learned Government Pleader for Land Acquisition on instructions stated that the allegation that the respondents are trying to forcibly dispossess the petitioners is incorrect and that their possession will not be disturbed without taking recourse to law.

In view of what has been stated by the learned Government Pleader, no further enquiry is necessary.

Accordingly, the Writ Petition is disposed of with a direction to the respondents not to interfere with the possession of the petitioners in respect of the lands in question without following due process of law. No costs.
