ORDER :
This writ petition is filed seeking a declaration that the action of the respondent No.3 in allegedly interfering with the peaceful possession and enjoyment of the petitioners in respect of the land in their occupation admeasuring Ac.0-04 cents situated in Sy.No.323/1 of Budawada Village, Marripadu Mandal, SPSR Nellore District is arbitrary and illegal.
It is pleaded by the petitioners that the land in question was assigned to them for house sites and the possession certificates were granted on 24.3.2003. It is claimed that the petitioners have constructed residential houses and they have been staying therein. Alleging that the respondents herein are trying to dispossess the petitioners forcibly without there being any justifiable reason, the present writ petition is filed.
The learned Government Pleader for Revenue on instructions submitted that the allegation that the respondents are trying to dispossess the petitioners forcibly is incorrect.
In view of what has been stated by the learned Government
Pleader, no further enquiry is necessary and accordingly the Writ Petition is disposed of with a direction to the respondents not to interfere with the possession of the petitioners in respect of the land wherein their residential houses are existing, without following due process of law. No costs.
