there is any objection for registration, under the scheme of the Registration Act, 1908 and the rules made thereunder, the registering authority has to record such reasons as contemplated under Section 71 of the said Act, but he has no authority to refuse to receive the document itself, when the same is presented for registration. As the registering authority has not recorded any reasons for refusal of registration, and as it is admitted in the counter affidavit filed by the 4th respondent/Tahsildar that the land in question is a patta land, I deem it appropriate to dispose of the writ petition, permitting the petitioner to present the document for alienation of land admeasuring 1440 square yards, covered by Sy.No.306/2 of Santhanuthalapadu village and Mandal of Prakasam District. If any such document is presented, the 3rd respondent shall receive the same and process it for registration. However, it is made clear that if any reasons exist for refusal of registration, the Sub-Registrar shall record such reasons as contemplated under Section 71 of the Registration Act and communicate the same to the petitioner. Otherwise, he shall register the document, provided the same is in accordance with the provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908.
