WRIT PETITION No.34209 of 2012

ORDER:

The Tahsildar, Anandapuram Mandal, respondent No.4 herein, initiated proceedings under Section 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 against the petitioners alleging that they have purchased the assigned land, admeasuring Acs.6.52 cents in Survey Nos.3/1 and 3/3 of Ramavaram Village, Anandapuram Mandal, Visakhapatnam District in contravention of the provisions of that Act. An order was passed on 29.11.2007 directing resumption of the land. Aggrieved by that, the petitioners filed an appeal before the Revenue Divisional Officer, Visakhapatnam, respondent No.3 herein. The appeal was dismissed through order, dated 31.01.2009. The petitioners filed further appeal before the District Collector, Visakhapatnam, respondent No.2 herein, together with an application for stay. Their grievance is that respondent No.2 did not pass orders either in the appeal or in the application for stay and that in the meanwhile, respondent No.4 is trying to interfere with their possession.

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue.

The petitioners have availed the remedy of further appeal

and three years have elapsed ever since it was filed. The matter of this nature cannot be kept pending indefinitely.

Hence, the writ petition is disposed of directing respondent No.2 to pass orders in the appeal preferred by the petitioners, within a period of two (2) months from the date of receipt of a copy of this order. Status quo obtaining as on today in respect of the land in question shall be maintained till then. There shall be no order as to costs.

The miscellaneous petition filed in this writ petition also shall stand disposed of.
