WRIT PETITION No.34195 of 2012

ORDER:

The petitioner was issued house site patta in respect of plot No.193-A carved out of Survey No.116 of Gondiparla Village, Kurnool Mandal and District in the year 2007. The petitioner states that he commenced the construction and his grievance is that the allottees of the neighbouring plots have demolished the same partly alleging that the plot was assigned to them. He made a representation, dated 13.08.2012, to the District Collector, Kurnool, respondent No.1 herein, with a request to resolve the dispute in this regard. His grievance is that no steps have been taken thereon.

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

The petitioner has filed a copy of the order of assignment in respect of plot No.193-A. The assignment is made by the Tahsildar, Kurnool Mandal, respondent No.3 herein. In case there exists any dispute between the allottees of various plots in the same layout, respondent No.3 can examine the record and pass appropriate orders. Unless the dispute is resolved, the very purpose of assignment would be defeated.

Hence, the writ petition is disposed of directing respondent No.3 to verify the matter pertaining to the

assignment of house site to the petitioner and ensure that the allottees of the respective plots are in possession and enjoyment of the same. There shall be no order as to costs.

The miscellaneous petition filed in this writ petition also stands disposed of.
