ORDER :
This writ petition is filed seeking a declaration that the action of the respondents in seeking to assign the land to an extent of Ac.4-21 cents in Sy.No.20/1, Ac.0-60 cents in Sy.No.58 and Ac.9-48 cents in Sy.Nos.45 & 58 situated in Kommanapalle Village, Thondangi Mandal, East Godavari District is arbitrary and illegal.
It is pleaded by the petitioners that they are owners and possessors of the above said lands. Though initially interim relief was granted by this Court by order dated 18.12.2001 in WPMP.No.32121 of 2001 directing the respondents not to dispossess the petitioners and not to assign the land in question in favour of third parties, subsequently the said interim order was vacated on 23.7.2002, having regard to the specific averments made in the counter-affidavit that the possession was taken on 13.3.1992 itself and subsequently the land was already assigned in favour of several other beneficiaries.
Though the petitioners preferred Writ Appeal No.49 of 2003, the Division Bench did not interfere with the order dated 23.07.2002 in WVMP. No.487 of 2002.
In the light of the above said order dated 23.7.2002, nothing
survives for adjudication on merits and accordingly the Writ Petition is dismissed. No costs.
