S. Padmaja Vs The District Collector

The petitioner made an application under Section 5-A (2) of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 (for short, ‘the ROR Act’) for regularization of the sale transaction dated 11.08.1995. Pursuant thereto, the petitioner was asked by the respondents to pay the requisite stamp duty as well as the registration fees as fixed by the Sub-Registrar, Kovur. Accordingly, the petitioner deposited the same in the Sub-Treasury, Kovur vide challan Nos.884 and 887 on 27.09.2006. In spite of the same, as the validation certificate in Form No.XIII-B of the ROR Act is not issued, the present writ petition is filed seeking a declaration that the inaction on the part of the 3^rd respondent, is arbitrary and illegal.

Heard the learned counsel for the petitioner as well as the learned Government Pleader for Revenue appearing for the respondents.

In the light of the material available on record, including the notice issued by the 3^rd respondent under Form No.XIII-A as well as the receipt of deposits made by the petitioner towards the stamp and registration charges on 27.09.2006, the 3^rd respondent is hereby directed either to issue the certificate in Form No.XIII-B in favour of the petitioner or in case there is any objection for issuing the said certificate, to communicate such objections to the petitioner within two (2) weeks from the date of receipt of this order.

The Writ Petition is accordingly, disposed of. No costs.
