At the first instance, counter-affidavit was filed by the Superintendent of Police. In the counter, while dealing with the allegations made in the writ petition, he stated that all possible steps were taken to apprehend respondents 3 & 4, but they could not trace them. It is further stated that both the accused are still absconding and there is no hope about their whereabouts in the near future. In view of the said statement made in the counter, this Court issued a direction for appearance of the Superintendent of Police to explain the steps taken to execute N.B.Ws pending for the last so many years. Pursuant to which, the Superintendent of Police appeared in person on 28.2.2012 and stated that respondents 3 and 4 were already arrested on 27.2.2012 and they were remanded to judicial custody. On the aforesaid date, the matter was adjourned to enable the learned Standing Counsel to file an affidavit explaining certain statements made in the earlier counter-affidavit. In response to the same, a further counter-affidavit was filed explaining the steps taken by the respondents for not executing NBWs against respondents 3 and 4.
