This writ appeal is directed against the order dated 20.7.2012 passed by the Hon’ble Single Judge in Writ Petition No. 21993 of 2012.

The appellant-writ petitioner filed the aforementioned writ petition before the Hon’ble Single Judge challenging the action of the 2^nd respondent in rejecting the application filed by the writ petitioner-society for grant of permission to it to impart education in D.EI.Ed. course as illegal, arbitrary, against the principles of natural justice and violative of Articles 14,16 and 19(1)(g) of the Constitution of India and for a consequential direction to grant permission to the writ petitioner-society to start “SREE VYSHNAVI D.Ed. COLLEGE’.

The Hon’ble Single Judge dismissed the said writ petition on 20.7.2012 after holding that the writ petitioner has a remedy of appeal under Section 18 of the National Council for Teacher Education Act, 1993 (for short ‘the Act’). Being aggrieved and dissatisfied with the said order of the Hon’ble Single Judge, the writ petitioner filed the present appeal before us.

Learned counsel appearing on behalf of the National Council for Teacher Education, the respondents herein, has agreed before us that the Council will give a hearing to the writ petitioner, if the writ petitioner

files an appeal under Section 18 of the Act within a period of one week from today.

Since Section 18 gives a right to the writ petitioner to file an appeal and if the writ petitioner files such an appeal within a week from today before the appellate authority, we only direct the appellate authority to consider the appeal so filed by the writ petitioner within a period of two weeks from the date of filing of such appeal before the said authority. We further make it clear that the time limit, as stipulated by the respondents till 31.8.2012 for processing the applications filed for the academic year 2012-2013 should be extended and accordingly it is extended in the case of the writ petitioner till the appellate authority passes an order on the appeal of the writ petitioner and communicate the same to the writ petitioner.

The writ appeal is disposed of on the above terms. No costs.
