TRANSFER CIVIL MISCELLANEOUS PETITION No.791 of 2011
ORDER :
Petitioner preferred the present petition under Section 24 of the Code of Civil Procedure, 1908, seeking to transfer O.P.No.781 of 2011 from the file of the Judge, Family Court, Vijayawada, to the file of the Judge, Family Court, Hyderabad.
Heard.
Learned counsel for the petitioner submitted that the petitioner is residing with her parents at Hyderabad along with her 4 years old daughter. Further, the respondent is also represented by G.P.A. holder, who is none other than his father.
Considering the facts and circumstances of the case, the present petition is allowed and O.P.No.781 of 2011 is hereby withdrawn from the file of the Judge, Family Court, Vijayawada, and transferred to Family Court, Hyderabad.
Further, the respondent’s presence before the Court below is dispensed with except on the date of his examination in chief and cross and the learned Judge insists for the same. Further, both the parties are directed to co-operate for speedy disposal of the matter.
There shall be no order as to costs.
Miscellaneous petitions filed in this petition, if any, shall stand closed.
