ORDER:
This petition is filed by the petitioner-wife seeking to transfer OP No.1412 of 2010 on the file of the Family Court, Visakhapatnam, to the Family Court, Rajahmundry, East Godavari District.
It is the case of the petitioner that the respondent-husband filed the above OP against her for restitution of conjugal rights in the Court of Visakhapatnam and that she along with her 11 months old baby is residing in Rajahmundry and it is difficult for her to travel to Visakhapatnam along with her child and therefore, the present OP may be transferred to the Family Court, Rajahmundry.
Even after service of notice, the respondent did not appear. It seems that he has no objection for transfer of the above OP.
Taking into consideration the circumstances of the case, the nature of the proceedings and the convenience of the parties, OP.No.1412 of 2010 on the file of the Family Court, Visakhapatnam, is transferred to the Family Court, Rajahmundry.
Accordingly, the Transfer CMP is allowed. Consequently, TrCMPMP No.161 of 2011 stands closed.
