ORDER:

This petition is filed by the petitioner-wife seeking to transfer O.P.No.206 of 2010, on the file of the Judge, Family Court, Ranga Reddy District at L.B. Nagar to the Court of the V Additional District Judge-cum-Judge, Family Court, Tirupati to be tried along with O.P.No.11 of 2011.

According to the petitioner, she filed F.C.O.P.No.11 of 2011 on the file of V Additional District Judge-cum-Judge, Family Court, Tirupati, for dissolution of her marriage with the respondent, whereas the respondent filed O.P.No.206 of 2010 on the file of the Judge, Family Court, Ranga Reddy District at L.B. Nagar, for restitution of conjugal rights, and therefore, O.P.No.206 of 2010 may be transferred to V Additional District Judge-cum-Judge, Family Court, Tirupati.

Admittedly, the petitioner is staying with her parents at Tirupati. The respondent herein does not appear before this Court for raising objection to transfer. Therefore, it is presumed that the respondent is not having any serious objection for transfer of the case as sought for by the petitioner.

Taking into consideration the facts and circumstances of the case, the nature of the proceedings and convenience of the parties, O.P.No.206 of 2010 is withdrawn from the file of the Court of the Judge, Family Court, Ranga Reddy District at L.B. Nagar, and transferred to the Court of V Additional District Judge-cum-Judge, Family Court, Tirupati to be tried along with O.P.No.11 of 2011.

With the above direction, the Transfer CMP is allowed.

The miscellaneous petitions filed in this revision, if any, shall stand closed.

There shall be no order as to costs.
