ORDER :
Petitioner preferred the present petition under Section 24 of the Code of Civil Procedure seeking to transfer F.C.O.P.No.72 of 2011 from Family Court, Nellore, to Senior Civil Judge’s Court, Srikalahasti. Heard.
Admittedly, petitioner-wife and her child are now residing at Srikalahasti. Respondent-husband filed the present O.P. seeking restitution of conjugal rights.
Considering the said circumstances, present petition is allowed and F.C.O.P.No.72 of 2011 is hereby withdrawn from the file of the Judge, Family Court, SPSR Nellore, and transferred to Senior Civil Judge’s Court, Srikalahasti, for disposal in accordance with law.
However, having regard to the submissions of counsel on either side, the Senior Civil Judge, Srikalahasti, is hereby directed to dispose of the matter so transferred to him within a period of three months from the date of receipt of the case file.
No order as to costs.
Miscellaneous petitions filed in this petition, if any, shall stand closed.
