THE HON’BLE SRI JUSTICE RAJA ELANGO CIVIL REVISON PETITION No.1005 OF 2012

ORDER:

This Civil Revision Petition is filed challenging the order dated 01.02.2012 passed by VI Additional District Judge, Fast Track Court, Narsapur, in I.A.No.2 of 2012 in O.S.No.102 of 2008, whereby the application filed by the petitioner/defendant to send the award copy passed by the Lok Adalat, Bhimavaram, containing the admitted signatures of the petitioner, to the Handwriting Expert along with the suit promissory note for comparison, was dismissed by the trial Court.

This Court perused the record and heard the arguments.

On an earlier occasion, this Court directed the learned counsel for the petitioner to verify as to whether the award dated 16.09.2006 passed by the Lok Adalat, Bhimavaram, in original is available with the petitioner.

Today, the learned counsel for the petitioner reported that the petitioner is having original of the award dated 16.09.2006 passed by the Lok Adalat, Bhimavaram and he is ready to produce the same before the trial Court to substantiate that the signature of the petitioner in the award is contemporary in nature.

In the circumstances, the petitioner is directed to file a fresh application before the trial Court for sending the disputed document i.e., suit promissory note along with the award dated 16.09.2006 passed by the Lok Adalat, Bhimavaram, to the Handwriting Expert for comparison. On filing such application, the trial Court is directed to send both the documents to the Handwriting Expert for comparison.

With the above directions, the Civil Revision Petition is disposed of. Consequently, the Miscellaneous Petitions filed in this revision, if any, shall stand closed. There shall be no order as to
