ORDER:
This revision petition is filed by the petitioner-plaintiff challenging the order dated 8.11.2011 passed in I.A.No.841 of 2011 in O.S.No.814 of 2007 by the III Additional District & Sessions Judge (FTC), Ranga Reddy District, L.B. Nagar.
The petitioner-plaintiff filed the above suit for cancellation of sale deed, for recovery of possession and injunction and the same is pending. While so, the petitioner-plaintiff filed the above application under Order XVI Rule 6 read with Section 151 CPC seeking a direction to D.W.2, who is a GPA holder of defendants 2 and 3 to produce original General Power of Attorney. The trial Court dismissed the said application. Aggrieved by the same, the petitioner-plaintiff filed this revision.
Heard both sides and perused the material on record.
It is the case of the learned Counsel for the petitioner that during the cross-examination, D.W.2 admitted that he can produce the original GPA executed by Y.C. Reddy and therefore, it is just and necessary to direct D.W.2 to produce the same.
The learned Counsel for respondents 2 and 3 fairly conceded that respondents 2 and 3 are ready to produce the original of GPA before the trial Court.
In view of the above submission, respondents 2 and 3 are directed to produce original of Ex.A8-GPA before the trial Court on or before 30.6.2012. On such production, the petitioner-plaintiff is at liberty to examine the witnesses, if he so chooses.
With the above direction, the Civil Revision Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, are closed.
