This revision is filed by the petitioner aggrieved by the order dated 18.6.2012 passed by the III Additional Chief Metropolitan Magistrate, Hyderabad, in Crime No.90 of 2012.

The petitioner, who is the brother of the 2^nd respondent-victim girl, filed the above Crl.M.P., under Section 17(A) of the Immoral Traffic (Prevention) Act, 1956 seeking to release the victim girl and to hand over her custody to him. He stated that the 2^nd respondent-victim was apprehended by the S.R. Nagar police while she was coming from movie and she was produced before the Court below on 26.1.2012 and the Court below had sent her to Prajwala Rescue Home, Charminar, Hyderabad, for rehabilitation. Further, he stated that the 2^nd respondent is innocent and he being the brother undertakes to look after her with utmost care and affection and provide her all amenities.

The Court below dismissed the above application and gave the custody of the 2^nd respondent-victim girl to the Prajwala Rescue Home for a period of one year from the date of the order, to take care of her and provide her with food, shelter, clothes and medical aid. Aggrieved by the same, the petitioner filed the present revision.

Heard and perused the material available on record.

Learned Counsel for the petitioner contends that the petitioner, who is the brother of the victim-girl, is a carpenter and he undertakes to provide all amenities to the victim-girl and that the victim girl has been in rescue home since January, 2012 and therefore, her custody may be granted to the petitioner.

On a perusal of the material available on record, it is clear that the age of the victim girl is about 24 years and she is in custody of rescue home since January, 2012.

Considering the facts and circumstances of the case, the order under revision is set aside and the 2^nd respondent-victim-girl is ordered to be released and her custody is to be handed over to the petitioner subject to the condition of the petitioner as well as the victim girl furnishing personal bonds for a sum of Rs.5,000/- each to the satisfaction of the III Additional Chief Metropolitan Magistrate, Hyderabad, and also on condition of the victim-girl furnishing an undertaking that she shall appear before the Court below as and when required in the above Crime.

With the above direction, the Criminal Revision Case is allowed. Consequently, miscellaneous petitions pending, if any in this revision, stand closed.
