CRIMINAL PETITION No.5551 OF 2012
ORDER:
The petitioner is accused of offences punishable under Sections 417, 420 and 306 IPC. The petitioner is stated to be working as Police Constable in Special Protection Force at Vijayawada. It is alleged that the petitioner and the deceased loved each other and that having promised to marry her the petitioner enjoyed the deceased sexually and that thereafter the petitioner began avoiding the deceased with an intention to marry another lady and that in spite of attempt of the deceased to contract the petitioner, the petitioner did not evince any interest on her and that therefore the deceased became frustrated and committed suicide by hanging. It is contended by the petitioner’s counsel that for the last three years, the petitioner is working at Vijayawada and hardly came to the village and that due to neighbouring disputes between the two families false allegations were foisted against the petitioner. As per the allegations, the deceased wrote a suicide note mentioning the above facts. In view of the allegations against the petitioner and loss of one life as consequence thereof, this is not a fit case for granting anticipatory bail to the petitioner.
In the result, the Criminal Petition is dismissed.
