The petitioner is accused of offences punishable under Sections 409 and 420 IPC. Allegation against the petitioner is that he has lifted paddy from APSCSCL for delivering custom milling paddy and that he has to deliver 3857.276 metric tones of rice, out of which, he delivered only 3450.117 metric tones and did not deliver 407.159 metric tones of rice as per memorandum of understanding. Value of under delivered custom milling rice is Rs.79,29,299.38 ps. From the said allegations, it cannot be said that no offences under Sections 409 and 420 IPC are made out herein. It is contention of petitioner’s counsel that this case was registered on report given by Assistant Manager (Tech), APSCSCL, Karimnagar dated 13.03.2012 and that subsequently on 14.05.2012, District Manager gave letter to the Inspector of Police to the effect that the petitioner delivered custom milling rice leaving a balance of 12.216 metric tones only.

If the petitioner delivered the entire balance of custom milling rice, then it is open to him and the District Manager of Andhra Pradesh State Civil Supplies Corporation Limited, Karimnagar to report the same to the Investigating Officer, in which event, the Investigating Officer will drop the proceedings.

Subject to the above observations, this Criminal Petition is closed.
