ORDER:
The petitioner/A2 is accused of offences punishable under Sections 353, 506/34 IPC along with others. It is alleged that the petitioner and others demanded Village Revenue Officer and other revenue officials for patta for Acs.0.15 cents in S.No.252/1, for which the revenue officials refused and that thereupon the revenue officers were abused and the Village Revenue Officer was pushed down and papers and files in his hands were snatched and were torn and that the accused obstructed the Village Officers in discharging their duties as such. It is contended by the petitioner’s counsel that false case was foisted as a counter blast for earlier private complaint given by the petitioner’s father to the Magistrate which was forwarded to the Police for registration and investigation. The earlier complaint was given four days prior to the present F.I.R. It was alleging the offences punishable under Sections 447 and 427 IPC. This earlier complaint relates to the same Ac.0.15 cents of land in which the revenue officials are stated to have trespassed and removed the stones planted around the same. Though the present F.I.R. is dated 13.11.2011, immediately after the present incident, report was given by the de facto complainant/Village Revenue Officer to the Collector on whose instructions the F.I.R. was lodged on 13.11.2011 with the
Police. Having regard to the allegations of man-handling revenue officials and obstructing them to discharge their duties as such, this is not a fit case for granting anticipatory bail to the petitioner.
In the result, the Criminal Petition is dismissed.
