CIVIL MISCELLANEOUS APPEAL No.523 OF 2009 JUDGMENT:
Under the instruction of the appellant – Yeruva Usha Kumari, her counsel Sri Nimmagadda Satyanarayana (5379) addressed a letter dated 19-11-2012 to the registry stating that the appellant wants to withdraw the appeal as the suit in O.S. No.82 of 2006, out of which the present appeal arose against the order in an interlocutory application i.e. I.A. No.32 of 2007 therein, on the file of the Court of learned Senior Civil Judge, Sathupalli was disposed of on 29-02-2012 and an appeal is preferred against the same in A.S. No.456 of 2012 before this Court,
as such, he sought for listing the matter under the caption ‘for withdrawal’ so a to enable him to withdraw the same.
Accordingly, the matter is listed today and when called up for hearing, Sri J. Subba Rao, learned counsel, representing the learned counsel for the appellant Sri Nimmagadda Satyanarayana, sought permission to withdraw the appeal stating as above and to that effect he also made an endorsement on the appeal bundle on behalf of his senior counsel Sri Nimmagadda Satyanarayana.
Therefore, permission is accorded and accordingly the Civil Miscellaneous Appeal is dismissed as withdrawn. The letter dated 19-11-2012, referred supra, shall form part of the record. The miscellaneous applications, if any, pending are also dismissed as withdrawn. No order as to costs.
