THE HON’BLE SRI JUSTICE B.N. RAO NALLA
CIVIL MISCELLANEOUS APPEAL No.2051 OF 2004 JUDGMENT:
None appears for the appellant and there is no representation on its behalf.
The proceeding sheet also discloses that on previous two consecutive occasions i.e. on 07-11-2012 and 16-11-2012 also, none appeared and there was no representation on behalf of the appellant.
In these circumstances, the non-indulgence of the appellant in prosecuting the appeal and causing its appearance and / or representation discloses its non-interestedness in doing the same, as such, this Court has no option except to dismiss the appeal for default.
In the result, the Civil Miscellaneous Appeal is dismissed for default/non-prosecution. The miscellaneous applications, if any, shall stand closed. No costs.
