Rampa Simhagiri Vs Kovvuri Venkata Reddy

This Civil Miscellaneous Appeal has been filed aggrieved by the Order dated 27.1.2009 passed in I.A.No. 253 of 2008 in O.S.No. 106 of 2008 on the file of VI Additional District Judge, Visakhapatnam.

Appellant herein is the plaintiff in O.S.No. 106 of 2008. He filed an application i.e., I.A.No. 253 of 2008 under Order 39 Rules 1 and 2 CPC for grant of temporary injunction restraining the respondents from making any constructions in the petition schedule property till disposal of the suit. The Court below dismissed that application. Aggrieved by the same, the present Civil Miscellaneous Appeal is filed.

When the matter is taken up for hearing, both the counsel agreed for the disposal of the main suit itself, as expeditiously as possible and they requested this Court that till the disposal of the suit, interim injunction granted by this Court be continued.

In view of the above request, without going into the merits or otherwise of the matter, this Civil Miscellaneous Appeal is disposed of directing the Court below to dispose of the main suit viz., O.S.No. 106 of 2008, within a period of six months from the date of receipt of a copy of this order and till such time, interim injunction granted by this Court on 18.3.2008 shall continue. There shall be no order as to costs.
