JUDGMENT:
None appears for the appellant – insurance company and there is no representation on its behalf. A perusal of the proceeding sheet discloses that on the last three consecutive dates i.e. 30.10.2012, 14.11.2012 and 28.11.2012 none appeared for the appellant and there was no representation on its behalf.
In the circumstances, it appears the appellant is not interested in prosecuting the appeal any further and this Court has no option except dismissing the appeal for default/non-prosecution.
Therefore, the C.M.A. is dismissed for non-prosecution. No order as to costs. Miscellaneous petitions, if any pending, stand closed.
