CONTEMPT CASE No.318 of 2012
ORDER:
This Contempt Case is filed alleging that the respondent has violated the directions issued by this Court in order, dated 31.12.2010 passed in WPMP.No.42692 of 2010 in Writ Petition No.33693 of 2010.
The said order passed by this Court is to the following effect:
“If the assignments granted to the petitioners are intact as on today, they shall not be dispossessed from the lands covered by such assignments.”
In this Contempt Case, though it is the allegation of the petitioners that the respondent has violated the aforesaid order passed by this Court, in the affidavit filed in support of the Contempt Case, they have not stated any particulars with regard to their dispossession.
In that view of the matter, this Court is of the opinion that there is no case made out by the petitioners to admit this Contempt Case. Even otherwise, learned counsel for the petitioners seeks permission of this Court for
withdrawal of the Contempt Case.
For the aforesaid reasons, I do not find any merit in this Contempt Case, which is accordingly closed. In view of disposal of the Contempt Case, C.A.No.266 of 2012 also stands disposed of.
