THE HON'BLE SRI JUSTICE R. SUBHASH REDDY WRIT PETITION No.7533 OF 2012
ORDER:
1 Heard the learned counsel for the petitioner. In this Writ Petition petitioner seeks a direction by way of mandamus to declare the action of the respondents 1 to 3 in not taking action on the representation of the petitioner dated 19.01.2012 and consequential legal notice dated 08.02.2012 and also to declare the interference of the respondents with the life and liberty of the petitioner as illegal and arbitrary.
2 In this Writ Petition, petitioner states that he is a practicing advocate at Eluru and he is in the habit of participating in social activities such as extending free legal aid to the poor etc. It is his grievance that though cockfighting is prohibited and illegal; and in spite of his representation to the respondent authorities, no steps have been taken. In the affidavit filed in support of the Writ Petition it is stated that during Pongal 2011 at various places in West and East Godavari Districts such cockfights were organized. As such, to prohibit such events during the Pongal 2012, he submitted a representation to the respondents. In spite of the same no action has been taken. In the affidavit, reference is made to a crime, which was registered against the petitioner at the instance of the 9th respondent.
3 A perusal of the affidavit filed in support of the Writ
Petition shows that there is no specific allegation against any of the respondents. All the allegations are vague and the petitioner has not referred to any specific instance. This Writ Petition is filed with vague allegations by making the authorities right from the Inspector of Police to the Secretary, Home Department, Government of Andhra Pradesh as parties without any factual foundation for the relief sought for. From the affidavit it appears that only in order to settle the scores with the police officials since some crimes have been registered against him, this Writ Petition is filed with all vague and untenable allegations, which are not capable of being answered by any of the respondents.
4 For the aforesaid reasoning, I see no grounds to admit the Writ Petition and accordingly, the Writ Petition is dismissed as devoid of merit at the stage of admission. No order as to costs.
