ORDER:
1 This Writ Petition is filed seeking a direction by way of mandamus to declare the action of the respondents in not conducting investigation and filing final report in Cr.No.26 of 2012 on the file of the second respondent-police station as illegal and arbitrary.
2 It is the case of the petitioner that he has filed a complaint against one Smt. S.Sujanamma and others alleging that she and her sons have attacked him and abused him by touching his caste. Based on the complaint of the petitioner, a case in Cr.No.26 of 2012 was registered on the file of the second respondent police station.
3 It is the grievance of the petitioner that though the crime was registered, no steps have been taken against the accused therein and no investigation is made in the said crime.
4 In this case it is to be noticed that the said crime was registered only on 13.02.2012. In that view of the matter, it cannot be said that there is any undue delay on the part of the investigating agency to accept the plea of the petitioner that the respondents are not investigating into the matter. Further, it is also to be noticed that the accused against whom the allegations are made are not even made as party respondents in this Writ Petition. In that view of the matter I
do not see any merit in this Writ Petition either to admit the same or to grant any direction as sought for.
5 Accordingly, the Writ Petition is dismissed as devoid of merit. No order as to costs.
