ORDER:
Having heard the submissions of learned counsel for the parties, it appears that the disputes which are cropped up in the matter are covered under the arbitration clause which is still in effect between the parties. Therefore, learned counsel for both the parties submitted that an independent Arbitrator may be appointed in the matter to adjudicate upon the disputes between the parties.
In these circumstances, since the parties have no objection, as agreed to by both the parties, Hon’ble Sri Justice A. Gopala Rao, a retired Judge of this Court, is appointed as a sole Arbitrator to adjudicate upon the disputes between the parties.
The parties shall be at liberty to take steps in the matter. The Arbitrator shall be at liberty to fix his remuneration at the meeting of the parties. The costs, charges and expenses, as to be fixed by the learned Arbitrator in the meeting of the parties held by him, are to be borne by the parties in equal share.
The Arbitration Application is accordingly disposed of.
