ORDER:
I have heard the learned counsel for the parties.
A counter affidavit has already been filed in this matter.
The applicant is seeking appointment of a sole Arbitrator to resolve the disputes pending between the applicant and the respondent. It is also submitted by the applicant and accepted by the respondent that the disputes raised between the parties are covered under the arbitration agreement. In view that, both the learned counsel appearing on behalf of the parties submitted that an independent person should be appointed who will act as a sole Arbitrator in the matter to settle the disputes between the parties.
In these circumstances, since the parties have no objection, Justice Vaman Rao (a retired Judge of this Court) is appointed as a sole Arbitrator to adjudicate upon the disputes between the parties.
The parties shall be at liberty to take steps in the matter. The Arbitrator shall be at liberty to fix his remuneration at the meeting of the parties. The learned Arbitrator shall be at liberty to appoint a Clerk and a Stenographer to assist him in the proceedings. The remuneration of the clerk and stenographer should be fixed by the learned Arbitrator to be shared equally by the parties. The costs, charges and expenses of the proceedings are to be borne by the parties in equal share.
The Arbitration Application is accordingly disposed of.
