Smt. Swarna Susilamma Prakasam Dist. Vs the Dist. Collector Prakasam Dist. and 4 Othrs

The petitioner has averred that the respondents 4 and 5 are raising illegal construction in the Government land in an extent of 0-02 cents in Sy. No.865 1A1A/2A1 situated at Kandukur Town, Prakasam District. It has been averred that the house of the petitioner is adjacent to the construction being raised by the respondents 4 and 5 in the afore-mentioned land. The petitioner submitted a representation dt.27.2.2011 before the respondent No.3 requesting him to stop the construction being raised by the respondents 4 and 5, but no action has been taken on the representation. Hence, this writ petition.

After hearing the learned counsel for the parties, this writ petition is disposed of with a direction to the respondent No.3 to consider the representation of the petitioner dt.27.2.2011 expeditiously, preferably within a period of ten days from today. In case any adverse order is to be passed against the respondents 4 and 5, then appropriate notice shall be issued to these respondents, before passing any such order. No costs.
