ORDER :-
This writ petition is filed to carry out the correction of entry in respect of land covered by T.S.No.4/2 of Musheerabad Mandal, Block “J”, Ward No.71 of Bakaram, Hyderabad admeasuring 21966 sq.metrs, as per the proceedings of the Chief Commissioner of Land Administration’s Ref.No.P5/1577/02, date 05.02.2003. By the said proceedings, the attention of the Collector, Hyderabad was drawn to the letter of the Deputy Director, Urban (S & LR’s), Hyderabad dated 09.01.2003, clarifying that as per circular No.C1/4392/94 DSS & LR’s, dated 15.10.1994, the survey records can be rectified under the provisions of B.S.O., 34 B-10 where the Survey was done under the Survey and Boundaries Act, 1923 and requested to report the action taken as reported in file No.B4/30/92, dated 17.06.1992 for correction of Survey record.
Learned counsel for the petitioner now submits that after claiming the land as a Government Land, L.G.C. has been filed, which prompted to file the present writ petition for correction of the entries and the L.G.C. filed by the Government has been dismissed. Hence, no further cause survives in the writ petition and he may be permitted to withdraw the writ petition to avail the remedies available to him, as and when the Government asserts his rights over the properties.
Permission is accorded.
The Writ Petition is, accordingly, dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs.
