W.P.No.13365 of 2003

Oral order:

The petitioner claiming to be running a hotel under the name and style “Sai Tea Stall” in a private land at Udaya Bhaskar Centre, Bhadrachalam, Khammam District filed this writ petition contending that due to heavy floods in the year 1986 the original records maintained by the respondents and also by the petitioner were lost and the respondents are taking steps to demolish the petitioner’s tea stall at the instance of local leaders; therefore, they should be restrained from demolishing the same without following the due process of law.

While issuing notice before admission on

07-07-2003, this Court granted interim stay of demolition, which was made absolute and continued to be in operation.

The respondents so far have not filed any counter opposing the writ petition. In view of the same, the writ petition is disposed of directing the respondents not to demolish the tea stall of the petitioner or dispossess him from the said tea stall without following the due process, viz. while issuing notice inform the petitioner that his possession is objectionable for the reasons stated in the said notice. No costs.
