D. Ramachandrudu Vs The Joint Collector

This writ petition is filed for a mandamus to set aside the order dated 16.12.2010 of respondent No.2, whereby he has suspended the petitioner’s fair price shop authorization.

Though at the hearing, Sri R.Ramanjaneyulu, learned counsel for the petitioner, raised several contentions on merits, in view of pendency of the enquiry before respondent No.2, it is not appropriate for this Court to deal with the same at this stage. Inasmuch as the order of suspension is in force for nearly two and half months, I am not inclined to interfere with the same pending enquiry.

The Writ Petition is accordingly disposed of with the direction to respondent No.2 to complete the enquiry and pass a final order within a period of one month from the date of receipt of a copy of this order,

after giving the petitioner an opportunity of being heard.

As a sequel to disposal of the writ petition, W.P.M.P.No.7462 of 2011 filed by the petitioner for interim relief is disposed of as infructuous.
