The Court made the following: ORDER:
This writ petition is filed for a mandamus to set aside the proceedings dated 29.09.2010 of respondent No.1, whereby he has suspended the petitioner’s fair price shop authorization.
A perusal of the impugned proceedings shows that on the basis of report dated 19.09.2010 of respondent No.3, wherein it was alleged that the petitioner diverted 200 litres of kerosene oil through an auto rickshaw, his authorization was kept under suspension by the impugned proceedings.
At the hearing, Sri T. Ramakoteswara Rao, the learned counsel for the petitioner, submitted that even though the order of suspension was made as far back as 29.09.2010, respondent No.1 has not
completed the enquiry and passed a final order. He requested that a direction may be given to respondent No.1 in this regard.
Having regard to the above submission of the learned counsel for the petitioner, without interfering with the impugned proceedings, the Writ Petition is disposed of with the direction to respondent No.1 to complete the enquiry and pass a final order within a period of six weeks from the date of receipt of a copy of this order.
As a sequel to disposal of the writ petition, W.P.M.P.No.5790 of 2011 filed by the petitioner for interim relief is disposed of as infructuous.
