ORDER:

The petitioner joined the service of Singareni Collieries Company Ltd., (S.C.C.L.) in the year 1977 as Badli Filler. Later on, he was assigned the duties of a Fan Operator. His date of birth was mentioned in the service register as 23.4.1953.

The petitioner states that he was declared unfit to continue in service in the recent past and in that connection he has been subjected to medical tests before various authorities. It is through this process that the petitioner is said to have come to know that though his date of birth as per the School Leaving Certificate is 10.6.1958, it was wrongly mentioned in the service register as 23.4.1953. He claims to have made a representation on 15.2.2011 to the respondents with a request to correct the date of birth. His grievance is that no action has been taken thereon.

Heard the learned counsel for the petitioner and Sri Nandigama Krishna Rao, learned Standing Counsel for the respondents.

The petitioner does not dispute that the date of birth entered in the service register is 15.12.1953. It is only in the recent past, that he claims to have noticed the discrepancy between the date of birth that is entered in the service register and the one which was mentioned in the School Leaving Certificate.

The question as to whether the Transfer Certificate relied upon by the petitioner is genuine, and if so, whether it can be relied upon at this stage, needs to be considered by the respondents.

Hence, the writ petition is disposed of directing the respondents to pass appropriate orders on the representation dated 15.2.2011 submitted by the petitioner within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.
