WRIT PETITION No.22533 of 2011

ORDER:

The petitioners challenge the action of respondent No.3 in not considering their cases for appointment as Assistant Helpers in the time-scale against the vacancies sanctioned by respondent No.1.The only ground on which their cases are not being considered is that they figured as accused in an additional charge sheet filed in C.C.No.722 of 2007 on the file of the Judicial First Class Magistrate, Sircilla.

Heard the learned counsel for the petitioner, the learned Government Pleader for respondent No.1 and the learned Standing Counsel for respondent No.2.

The identical case was considered by this Court in W.P.No.18120 of 2011. As in the instant case, there also, the names of the petitioners did not figure in the complaint, F.I.R. or the charge sheet in a case pertaining to the allegations of gheraoe of the Managing Committee. Their names were mentioned only in the additional affidavit. This Court took the view that the person, whose name figured in the additional charge sheet, cannot be denied the benefit of appointment as Assistant Helper in the timescale.

Following the order, dated 02.08.2011, in W.P.No.18120 of 2011, this writ petition is also allowed directing the respondents to consider the case of the petitioners for appointment as Assistant Helpers without reference to the fact that their names are mentioned in the additional charge sheet. However, if they are appointed, such appointment shall be subject to the outcome of the criminal case. There shall be no order as to costs.
